Japan Association for Construction Human Resources (hereinafter referred to as "the Organization") recognizes the importance of protecting all personal information handled in the course of the Organization's business activities, and will endeavor to protect personal information by thoroughly informing all of its officers and employees that it will respect and comply with the Personal Information Protection Act and other relevant laws and regulations, as well as guidelines from relevant ministries and agencies, in accordance with the following policy.

In addition, the Organization has established the following personal information protection policy and will strive to handle and manage personal information appropriately while striving for continuous improvement.

  1. We will comply with the Personal Information Protection Regulations, which stipulate the appropriate acquisition, use, and provision of personal information taking into account the nature and scale of our business.
  2. All personal information acquired by the Organization in the course of its business activities will be used for the purposes and within the scope of use for which the individual's consent has been obtained.
  3. We will take measures to prevent unauthorized access to personal information, as well as the loss, destruction, falsification, leakage, etc. of personal information and to ensure other appropriate management of such information, and in the unlikely event that an accident does occur, we will implement prompt corrective measures.
  4. We will respond promptly and appropriately to any complaints or inquiries from individuals who are the subjects of personal information.
  5. We will comply with laws, regulations and other standards regarding personal information.
  6. We will promote activities to continually improve our personal information protection management system.

Handling of personal information

1. Definition of personal information

Personal information refers to personal information as defined in Article 2, Paragraph 1 of the Act on the Protection of Personal Information (hereinafter referred to as the "Personal Information Protection Act"), including a user's address, name, age, telephone number, email address, date of birth, sex, place of employment, annual income, residence card number, residence status, passport number, SNS account name, etc., and refers to information that, either alone or in combination with multiple elements, can identify or is likely to identify a specific individual.
The Organization may obtain attribute information from users or third parties that does not constitute personal information on its own. When a user provides the Organization with personal information, the Organization may link that information to attribute information. In this case, the attribute information will also be treated as personal information.


2. Acquisition of personal information

Personal information will be acquired through appropriate and lawful means.
In addition, when making various inquiries or consultations, we may record telephone conversations in order to accurately understand and respond to the content, etc.


3 Purpose of Use of Personal Information

Personal information will be handled within the scope of the following restrictions on use. If personal information is to be used outside the scope of the specified purposes, the individual will be notified.

  1. Proper implementation of the Code of Conduct for the realization of proper and smooth acceptance of foreign human resources in the construction sector
  2. Project to improve the environment in which foreign human resources in the construction sector can effectively utilize their skills
  3. Project for accepting specified skilled workers in the construction field
  4. Employment placement business for specified skilled workers in the construction field
  5. Projects related to skill evaluation of construction technicians and securing other construction technicians

4. Safety management measures for personal information

Personal information will always be kept accurate and up-to-date within the scope of the intended use.
When outsourcing the processing or management of personal information, we will select a party that is deemed to be handling personal information appropriately and enter into a confidentiality agreement with them. When outsourcing, we will provide necessary and appropriate supervision of the outsourcing party, including supervision of sub-outsourcing parties.
In addition, we will appoint a personal information protection manager within our organization to ensure proper management of personal information and provide ongoing education.


5. Provision of personal information to third parties

Except in the following cases, the Organization will not provide personal information to a third party without the prior consent of the individual.

  1. When required by law
  2. When it is necessary for the protection of a person's life, body, or property and it is difficult to obtain the individual's consent.
  3. When it is necessary to cooperate with a national government organ, local government, or a person commissioned by them in carrying out duties prescribed by law, and obtaining the individual's consent is likely to impede the performance of those duties.
  4. When it is necessary to disclose personal information to financial institutions, settlement companies, etc. in order to bill for membership fees under specified skilled workers System.
  5. When the information is outsourced to an external party within the scope necessary to achieve the intended purpose of use.

In addition, when the handling of personal information is outsourced to the extent necessary for the above-mentioned purposes of use, we will provide necessary and appropriate guidance and supervision to the outsourced parties, business partners, etc.


6. Provision of personal information to third parties in foreign countries

The Organization may provide personal information to third parties in foreign countries within the scope of the purposes described in "3. Purpose of Use of Personal Information." Personal information may be provided to third parties in foreign countries in the following cases:

  1. When providing information to a third party in a country designated by the rules of the Personal Information Protection Commission as a country that has a personal information protection system that is recognized as being at the same level as Japan
  2. When providing personal information to a third party that has established a system that meets the standards set out in the regulations as a system necessary for a personal information handling entity to continuously take measures equivalent to those that should be taken
  3. When the user has agreed in advance to allow the provision of personal information to the third party

In addition, 1. When providing personal information to a third party in a country specified by the Personal Information Protection Commission Rules as a country with a personal information protection system that is recognized as being at the same level as Japan, we will take the same measures as for a third party in Japan in accordance with the provisions of the Personal Information Protection Act. 2. When providing personal information to a third party that has established a system that complies with the standards specified by the Rules as a system necessary for a personal information handling business operator to continuously take measures equivalent to those that should be taken, we will take the necessary measures to ensure that the compliant system is continuously maintained. 3. If the user has agreed in advance to allow the provision of personal information to the third party, we will provide the user with the name of the foreign country to which the personal information will be provided, information on the system for protecting personal information in that foreign country obtained by appropriate and reasonable means, and information on the measures for protecting personal information taken by the third party, in accordance with the provisions of the Personal Information Protection Commission Rules, before receiving the provision of personal information.


7. Cookies

Websites operated by the Organization may use cookies and similar technologies to collect information such as browsing status of websites, etc. These technologies help the Organization understand the usage status of websites and services, etc., and contribute to improving services. Users can change their browser settings to display a warning before receiving cookies or to refuse to receive cookies. However, if cookies are refused, websites and services, etc. may not function properly.


8. Use of web access analysis tools

When the Organization receives a request from the person who is the subject of personal information or his/her agent for disclosure, correction (addition/deletion), suspension of use, erasure, notification of purpose of use, etc. (hereinafter referred to as "disclosure, etc."), the Organization will promptly respond in accordance with the procedures specified by the Organization. For requests for disclosure, etc. of personal information held by the Organization, please contact the inquiry desk described in 11. Establishment of a Personal Information Desk.


10 Management of personal information of job seekers, etc.

1. The scope of the employees of the Organization who handle personal information acquired in relation to the employment placement business and recruitment information provision business conducted by the Organization shall be the employees of the Administration Department, the Examination Management Department, the Employment Placement Department, and the Specific Recruitment Information Provision Business Department of the Business Department. In addition, the person responsible for handling personal information shall be the Executive Director.

2. The person in charge of handling personal information will provide education and guidance on the handling of personal information at least once a year to the employees of the Organization who handle personal information and are listed in 1. above.

3. We will properly manage the personal information we obtain to prevent unauthorized access, theft, loss, destruction, falsification, and leakage, and will take the necessary preventive and corrective measures.

4. In order to respond appropriately to socio-economic changes, the Organization will continually review and strive to improve its policies and systems for protecting personal information held by the Organization.


11. Establishment of a contact point for personal information

The Organization will set up a personal information inquiry desk to receive complaints and other inquiries appropriately.


12 Governing Law and Language

This Privacy Policy is governed by and construed in accordance with the laws of Japan. In the event of any discrepancy between the Japanese version of this Privacy Policy and any other language version, the Japanese version shall take precedence.
